Welcome to the Lotay Wellness website. These Terms and Conditions govern your use of our website and outline important policies related to your interactions with our clinic. By accessing and using this website, you agree to comply with and be bound by the following terms and conditions:
1. Definitions
In these Terms the following definitions shall apply:
· “Advice” means any advice or information provided (whether through voice communication, video or electronically or in writing) by Lotay Wellness
· “Services” means those services that we agree to provide to you which may include (without limitation) Advice, formulation of Treatment Plans, provision of Treatments, arrangement of investigations, referrals to specialists, prescription of medicines, and the sale of Products;
· “Treatment” means the Advice, procedures, tests and medications provided to you in accordance with your Treatment Plan;
· “Treatment Plan” means the bespoke treatment plan formulated for you by Lotay Wellness with shared decision making based (without limitation) on symptoms, results of tests, medical reports and diagnoses from Doctors, and other relevant information provided by you.
2. Registration and Eligibility
When you register with us, you agree to provide us with the following:
· your full name, including any middle names
· date of birth
· full postal address including post code
· your GP name and address
· a photo ID (passport or driving licence) for identification purposes at the time of consultation (applicable to virtual consultations only)
You confirm to the best of your knowledge that the information you have provided is complete and accurate.
A copy of your identification will be stored on our secure MediOffice medical software in your medical record for future identification purposes for virtual consultations. The Medioffice platform meets the requirements of GDPR.
You agree, at all times, to provide us with accurate and complete information in your registration and to update us if any information changes.
3. Consultations
Virtual Consultations
You must have available a photo proof of identity (for example a Passport or Driver’s License) to show the clinician at the start of your video consultation. If we cannot verify your identity, we may choose to cancel the consultation. Please therefore ensure that you provide correct and accurate information.
We will record the results of the consultation as required by law and regulatory requirements on MediOffice Software. You agree to review and inform us of anything that you believe to be incorrect or inaccurate.
For initial virtual consultations, you must provide accurate and up to date information required for your consultation (blood pressure, height and weight) Any information which is not provided will mean that we may postpone the consultation until we have this information.
Face to face consultations
You must ensure that all the information provided is true and accurate.
4. Prescriptions
If required, a private prescription will be issued by Herpreet Kaur-Lotay Sharma independently from Lotay Wellness. This can be dispensed by any local pharmacy.
You understand and accept that there is no guarantee that you will be approved to receive a prescription following a consultation. Prescriptions are issued at the sole discretion of the clinician.
Please note that the only controlled drug that we can prescribe at Lotay Wellness is Testosterone, if deemed appropriate. This medication is classified under Controlled Drugs Schedule 4 Part 2.
All medications prescribed will be related to hormone replacement therapy and menopausal transition.
Lotay Wellness has no control over or responsibility for any individual pharmacy, or its policies in relation to the acceptance or processing of prescriptions, the dispensing of medication, or delivery.
5. Use of the Website:
You agree to use this website for lawful and informational purposes only. You shall not use this site for any unlawful or prohibited activities.
6. Privacy Policy:
Your use of this website is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.
7. Intellectual Property:
All content on this website, including text, graphics, logos, images, and software, is the property of Lotay Wellness and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use our content without our express written consent.
8. Cancellation Policy:
For all consultations, please notify us at least 24 hours in advance if you need to cancel or reschedule your appointment. Failure to do so may result in a cancellation fee.
9. Payment Section:
Payment methods will be communicated to you during the appointment booking process.
10. Nature of Service:
Lotay Wellness provides specialised menopause-related healthcare services, including perimenopause consultations, menopause consultations, follow-ups, HRT reviews and lifestyle reviews. All services are delivered by a qualified healthcare professional registered by the General Pharmaceutical Council (GPhC). Our services are not suitable for any emergency medical situations or any diagnosis or treatment which requires a physical examination.
11. Refunds:
Payments made for our services, including consultations and related fees, are non-refundable. If you have concerns or questions about your service, please contact us, and we will make every effort to address them.
12. Remote Consultations:
Virtual consultations are available for your convenience and is provided through end to end encrypted video consulting platform (Medioffice). It is the clients responsibility to provide accurate and up-to-date information during these consultations to facilitate the provision of optimal care.
13. Changes to Terms and Conditions:
We may update these Terms and Conditions at any time without notice. The latest version will always be available on our website, with the effective date noted.
14. Governing Law and Jurisdiction:
These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from the use of this website will be subject to the exclusive jurisdiction of the courts of England and Wales.
